The Commission on GMOs

- the opinion making and advisory body to the Minister of the Environment

 

 

In accordance with article 12 of the act on 22 June 2001 on genetically modified organisms a GMO Commission shall be established as the opinion making and advisory body to the minister competent for GMOs. The Commission shall consists of 19 members appointed by the minister for 4 years. Members of the Commission shall include:

  • one representative selected by:

    1. the minister competent for public health,

    2. the minister competent for agriculture,

    3. the Minister of National Defence,

    4. the minister competent for economy,

    5. the minister competent for transport,

    6. the minister competent for science,

    7. the minister competent for the environment,

    8. the President of the Office for Competition and Consumer Protection,

  • seven representative of scientific circles with renowned authority and competence in environmental protection, health care, biological safety, biotechnology, plant breeding, and ethics appointed in agreement with the minister competent for science, the minister competent for public health, and the minister competent for agriculture,

  • a representative of entrepreneurs from the biotechnology sector appointed in agreement with the minister competent for economy and the association of employers,

  • two representatives of non-governmental environmental organisations proposed by such organisations,

  • a representative of consumer organisations.

The Chairman of the Commission, the Deputy Chairmen, and Secretary of the Commission shall be appointed and dismissed by the minister from among the members of the Commission.
Membership in the Commission shall expire before the term of office consequent of death or resignation of a Commission Member or dismissal by a competent body of representatives.
Expenses related to activities of the Commission shall be covered from the state budget in the part which is at the disposal of the Minister.

Duties of the Commission shall include:

  • Opinion making on grant of consents or permits referred to:

    1. deliberate release of GMOs into the environment,

    2. contained use of GMOs,

    3. place GMO products on the market,

    4. export or transit GMO products,

  • Opinion making on matters submitted by the minister within the scope of his competencies under the Act,

  • Opinion making on legal acts related to GMOs and biological safety,

  • Opinion making on assumptions of state policy on GMO applications and biological safety.

The Minister specified a detailed method of Commission's activity, including organisational structure and operating method of the Commission given its assigned tasks in The Regulation of The Minister of the Environment on 21 February 2002 laying down the detailed rules of procedure for the Commission on Genetically Modified Organisms.
